1. Acceptance of Terms

By accessing or using the Rent a Car in Samoa platform ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. About the Platform

Rent a Car in Samoa (www.rentacarinsamoa.com) is operated by ACA Consult NZ. It is a marketplace that connects local vehicle operators in Samoa with visitors seeking to rent vehicles. Renters send booking requests through the Platform and each operator confirms directly with the renter. We act solely as a platform facilitator — we are not a party to any rental agreement between operators and renters, and we do not own, manage, or operate any of the listed vehicles.

3. User Responsibilities

By using this platform, you agree to:

• Provide accurate and truthful information in all submissions
• Use the platform only for lawful purposes
• Not misrepresent yourself, your vehicle, or your intentions
• Treat all other users with respect and professionalism
• Comply with all applicable laws and regulations of Samoa

4. Vehicle Listings

Vehicle owners are solely responsible for the accuracy of their listings, including vehicle details, pricing, availability, and photos. Owners must ensure their vehicles are roadworthy, legally registered, and appropriately insured before listing them on the platform. We reserve the right to remove any listing that we deem inappropriate or inaccurate.

5. Rental Agreements

Any rental arrangement made through this platform is strictly between the vehicle owner and the renter. We are not responsible for disputes, damages, losses, or liabilities arising from any rental transaction. We strongly encourage both parties to agree on the terms of the rental in writing before proceeding.

6. Rental Payments

Rent a Car in Samoa does not take payment for rentals. Renters pay the vehicle operator directly, including any bond, on the terms the operator sets. There is no booking fee for renters. We are not responsible for any payment disputes or fraudulent transactions between renters and operators.

6A. Listing Fees for Operators

Operators pay ACA Consult NZ a monthly listing fee per vehicle to list on the Platform and use its booking calendar. New operators list free for their first 3 months; after that the fee is WST 50 per vehicle per month. No commission is charged on rentals. Current fees are shown on the Operators page and may change with 30 days' notice. Listings may be paused if fees are unpaid.

7. Reviews & Inquiries

Users may submit reviews and inquiries through the platform. You agree that any content you submit is accurate, honest, and does not violate any third-party rights. We reserve the right to moderate, edit, or remove reviews that are deemed inappropriate, offensive, or fraudulent.

Reviews go both ways. After each rental the renter reviews the vehicle and operator, and the operator reviews the renter. Both reviews stay hidden until both sides have posted, or until 14 days after the car is returned. Reviews of vehicles and operators are public. Reviews of renters are shown only to operators when that renter sends them a booking request, and to the renter in My Rentals. Renters may post one reply to each review about them. Reviews must be about the rental itself; anyone can report a review for checking.

8. Limitation of Liability

To the fullest extent permitted by law, Rent a Car in Samoa and its operators shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to vehicle damage, personal injury, or financial loss resulting from a rental transaction.

9. Intellectual Property

All content on the platform — including text, design, logos, and graphics — is owned by or licensed to Rent a Car in Samoa. You may not reproduce, distribute, or use any content without our prior written consent.

10. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with a revised date. Continued use of the platform after changes are posted constitutes your acceptance of the updated terms.
